Rental Terms & Conditions

DRAFT — these terms have not yet been reviewed by a Thai-qualified lawyer. They reflect industry best practices sourced from public Thai legal references but should not be relied upon as legal advice. Final version pending lawyer review.
Driver's license & International Driving Permit (IDP)
You must hold a valid driving license for the vehicle class you rent. Foreign visitors: bring your home-country license AND an International Driving Permit (IDP). The IDP must include the correct vehicle category — Category A for motorcycles/scooters, Category B for cars. A car-only IDP does NOT cover scooters in Thailand.
Driving without the correct license is illegal under Thai law and will void your insurance coverage in case of accident. You will be personally liable for all damages, medical costs, and third-party claims.
Helmet requirement
Helmets are mandatory by Thai law (Land Traffic Act, Section 122) for both rider and passenger at all times. A helmet is provided with every motorcycle rental. Riding without a helmet exposes you to a fine of up to THB 2,000 per person (doubled if a helmet is on the bike but unworn). It also voids your insurance coverage in case of accident.
Minimum age
Minimum age is 18 for motorcycles and scooters, 21 for cars. Some vehicles may require a higher minimum age — see vehicle details before booking. You must hold a valid license issued at least 1 year before the rental date.
Insurance coverage
Every vehicle on RideSamui is covered by Thailand's Compulsory Motor Insurance (Por Ror Bor), which provides third-party medical and death benefits as required by the Motor Victims Protection Act B.E. 2535 (1992).
This compulsory insurance does NOT cover damage to the rental vehicle, theft, or damage to third-party property. Comprehensive coverage, where offered by the agency, is optional and provided at the agency's discretion.
Unless explicitly stated in your rental agreement, you are personally liable for: damage to the rental vehicle, theft or loss of the vehicle, damage to third-party property, and any costs above the Por Ror Bor coverage limits.
Cancellation policy
The cancellation policy for your booking is set by the agency and shown at booking time before you confirm. If you cancel before the cancellation deadline, you'll receive a refund per that policy. After the deadline, no refund applies. Please review the displayed cancellation terms carefully before confirming your booking.
Governing law and jurisdiction
This agreement is governed by the laws of the Kingdom of Thailand. Any dispute arising from your use of RideSamui shall be subject to the exclusive jurisdiction of the competent Thai courts. You may also file a consumer complaint with the Office of the Consumer Protection Board (OCPB) at any time.
Customer liability
You are responsible for the vehicle from pickup until return. You agree to be liable for any damage, loss, or theft of the vehicle, and for any third-party damage you cause, except to the extent covered by the Compulsory Motor Insurance (Por Ror Bor) or by any optional comprehensive coverage purchased through the agency. The agency may require a security deposit at pickup; the deposit will be refunded at vehicle return if no damage or violation is identified.
Tax invoices
RideSamui acts as an intermediary platform connecting you with independent rental agencies. The rental service is provided by the agency you book with, and the agency is responsible for issuing the tax invoice (ใบกำกับภาษี) for the rental, if applicable. Please contact the agency directly to request a tax invoice.
